Here is a copy of our Contract and Warranty. Signed and official documents will be sent with every puppy ( Whose adoption fee is over $1000.00 )at pick up:
REGISTRATION AND OWNERSHIP TRANSFERS
Upon payment in full as set forth above, Seller shall promptly take all legal actions necessary to officially transfer ownership and registration, if applicable, of the Dog to Buyer.
SELLER REPRESENTATIONS
Seller warrants to Buyer that Seller is the legal and valid owner of the Dog and that Seller has the unqualified right to sell the Dog. Furthermore, Seller warrants that the Dog is sold free and clear of any lien, security interest, mortgage, or other encumbrance.
WARRANTIES
The Dog is in good health and free of communicable diseases at the time of this sale. Buyer has 72 hours from the purchase and delivery date to have the Dog examined by a licensed veterinarian (Buyer will pay all veterinarian fees). If the Dog fails the examination, the Buyer, with a written statement from the veterinarian, may return the Dog to the Seller for a full refund (not including shipping fees if applicable). This does not include any parasites, including but not limited to Giardia and Coccidia. Parasites are common, and though generally easy to treat, puppies can reinfest themselves easily. We have an aggressive deworming protocol, and your puppy has preventatively been treated for all common parasites. Any positive test results are a failure of the medication and not a failure of the breeder to pre-treat for them. The seller is not liable for any accident or injury of the animal once it leaves the seller's premises.
Our Warranty covers your puppy in the unfortunate event that he/she is diagnosed with a congenital or genetic health issue that is life-threatening or greatly diminishes their quality of life within 24 months of birth. If this should occur, you may elect to either (1) receive a replacement puppy of the same sex (In the case of death or terminal illness only) or (2) receive reimbursement of vet bills for treatment of said health issue up to 1/2 (Half) the original purchase price of the puppy. A necropsy is REQUIRED for any claim due to death. Reimbursement is for Treatment only, no reimbursement for tests or diagnosis of said condition will be given. All reimbursements MUST be submitted and treatment provided within 1 year (12) months of said diagnosis. You will NOT be required to return the original puppy. The guarantee is invalid if the development is due to injury, neglect, obesity, or rapid growth due to poor nutrition. Buyer must provide Seller with access to all Veterinary records and speak directly with the Buyers Vet.
Hip Dysplasia (HD) (http://offa.org/hd_info.html) and/or Elbow Dysplasia (ED) (http://offa.org/ed_types.html). The diagnosis of hip dysplasia (moderate or severe) or an elbow dysplasia rating of Grade 2 or 3. X-rays are to be taken by a licensed DVM and submitted to the OFA (Orthopedic Foundation for Animals, www.OFFA.org). Copies of report(s) to be provided to Seller.
Eye Disorders. Congenital defect of the eye causing progressive blindness in one or both eyes and/or requiring surgery or ongoing medication, as diagnosed by a Veterinary Ophthalmologist. (Proof to include copies of diagnosis and treatment documentation from a board-certified veterinary ophthalmologist.)
Cardiac (heart) disorders requiring surgery or a heart disorder requiring life-long medication diagnosed by a Board-Certified Canine Cardiologist.
OFA must verify OCD, Patella, Legg Calves. Patellas are covered until 16 weeks of age Only.
The diagnosis must be made by a DVM or for Hip Dysplasia or any orthopedic issue an OFA radiologist and forwarded to us before their second birthday. No replacements will be given due to problems that result from buyer neglect. The buyer understands that all shipping expenses are the sole responsibility and will not be refunded.
This warranty does not include viral illnesses, infections, improper bites, heart murmurs, hernias, or parasites. It also does not cover conditions due to the ingestion of foreign objects, food, chemicals, or physical injury.
The buyer agrees to maintain this dog in good health provide routine preventative health care, including but not limited to inoculations, internal and external parasites, and preventive medications. Buyer agrees to provide fresh water and proper quality food in the correct amounts. Veterinary records must be provided to the Seller if requesting a refund or replacement. If any preventative care has not been provided, the health warranty will be null and void. If the puppy is not spayed/neutered by their eighth month, the guarantee is null and void. Should a replacement puppy or financial compensation be requested at any time during the two years, proof that the current dog was spayed or neutered by 8 months is required, or guarantee is null and void.
BINDING EFFECT
The covenants and conditions contained in this Bill of Sale shall apply to and bind the parties and the heirs, legal representatives, successors, and permitted assigns.
SEVERABILITY
If any part or parts of this Bill of Sale shall be held unenforceable for any reason, the remainder of this Bill of Sale shall continue in full force and effect.
ENTIRE AGREEMENT
This Bill of Sale constitutes the entire agreement between the parties and supersedes any prior understanding or representation of any kind preceding the date of this Bill of Sale. This Bill of Sale may be modified in writing and signed by both Buyer and Seller.
ADDITIONAL PROVISIONS
If the Buyer can no longer care for the dog, it may be returned to the Seller with no questions asked. No monies will be refunded.
The buyer understands there is no guarantee that Doodles are completely hypo-allergenic or non-shedding. Buyer also understands that Seller’s prediction of adult weight, height, and coat type are estimates only and are based on the Seller’s goal to match puppies with families appropriately. Doodles are a hybrid of one or more breeds, a poodle, and other breeds that have been infused for size, color, and patterns.
We do not allow the use of Trifexis, Nexguard, Symparico or Symparica Trio on our puppies. We will not refund or replace any dog that has used these products at any time. Proof of veterinary Records is required for any reimbursement claim.
We do not replace or refund any dog or puppy with seizures, neurological issues, or Death that use ANY type of ingestible pesticides as these are known and documented to have these side effects.
SPAY/NEUTER AGREEMENT
This dog is sold strictly on a NO breeding contract. This dog must be spayed or neutered no later than 8 months of age, or the Health Warranty is null and void. If this dog is used for breeding purposes, legal action will be taken against the buyer for no less than double the purchase price plus legal fees.
IN WITNESS WHEREOF, Seller has executed and delivered this Dog Bill of Sale. You hereby agree to the conditions as set above by taking possession of the dog.
GOVERNING LAW
This Bill of Sale shall be governed by and construed in accordance with the laws of the State of Georgia
